The SDI Review Process

There are four possible outcomes from the SDI Review process: Approval or denial, remand to obtain additional information, recommendation for waiver, or remand. The SSA reviews the SSDI and decides whether or not to approve, deny, remand, or request additional information. It then sends a memorandum to the MDH Unit informing it whether the data-related arrangement is approved, denied, deferred, and remanded. If the agreement was approved, the MDH Unit can move with execution.

If an application for asylum is denied by the SSA, a second notice will be sent. After the date of denial, the applicant has sixty-five calendar days to request an administrative law judge (ALJ) hearing. This hearing is the same as those on disability issues. This hearing can be held in person or over the telephone, or via videoconference. During the hearing, the applicant or his or her representative can bring witnesses to testify about the issues and the circumstances surrounding the denial. An ALJ may arrange for expert witness testimony to support the case. The ALJ may notify the applicant by writing if they lose. The hearing could take many months.

A disability review may take three to seven years. It can be approved, denied or remanded for more information. If an individual is able or able, the SSA may initiate a disability evaluation.

Cognito Forms - Data-related agreement submitted by SDI Team

A Data-Related Agreement (DRA) is a legal document which requires the approval of the SDI Team before execution. These agreements must be submitted through Cognito Forms and must include the relevant documentation and proposed contracts. The SDI Team will have 30 days to review the Data-Related Agreement. They can also ask for additional information, such a SOC 2 Type II or security controls. They can also ask any additional questions, including questions regarding data migration.

Once a Data-Related Agreement (DRA) is submitted, the SDI Team reviews the documents and will recommend contracts. The Agreement is subjected to the same privacy/security policies as other forms submitted through Cognito Forms.
