The SDI Review Process

One of the four outcomes of the SDI Review process is approval, denial or remand for more information. Or recommendation for waiver. After receiving the SSDI review completed by the SSA, it determines whether to approve or deny and if it should remand for further information. It then sends a memo to the MDH Unit, indicating whether the data-related agreement is approved, deferred, or remanded. The MDH Unit may execute the agreement if the agreement has been approved.

If an application has been denied, the SSA will issue a second notice. The denied applicant has sixty-five days from that date to request a hearing before an Administrative Law Judge (ALJ). Similar to hearings on disability issues, this hearing can be requested. The hearing can be conducted in person, by phone or videoconference. During the hearing, the applicant or his or her representative can bring witnesses to testify about the issues and the circumstances surrounding the denial. An ALJ can also arrange for expert testimony in support of the case. The ALJ will inform the applicant in writing if the application is denied. This hearing can take up to several months.

The process of a disability review can take anywhere from three to seven years. It can be approved, denied or remanded for more information. If the person has made significant improvements in their medical condition and is able to return to work, the SSA can also initiate a disability review.

Data-related agreement submitted to SDI Team through Cognito Forms

A Data-Related Agreement can be a legal document that must be approved by SDI Team before being executed. These agreements must be submitted via Cognito Forms. They must also include relevant documentation and contracts. The SDI Team has 30 days to review a Data-Related Agreement, and they may ask for more information such as security controls and a SOC 2 Type II audit. They can also ask any additional questions, including questions regarding data migration.

Once a Data-Related Agreement is submitted, the SDI Team will review the documentation and proposed contracts. The Agreement is subject the same privacy policies and security guidelines as any other documentation submitted through Cognito Forms.
